Öz
Türkiye’de velayet değerlendirmelerinde kullanılan yöntemlerin belirlenmesi amacıyla yapılan bu araştırma betimsel tarama modelinde tasarlanmıştır. Oranlı örnekleme yöntemi ile belirlenen 292 adli destek görevlisi araştırmaya katılım göstermiştir. Veriler anket tekniği ile toplanmış ve bulgular velayet değerlendirmelerinde görev alan adli destek görevlilerinin mesleki donanımı, velayet değerlendirmelerinin özellikleri, velayet değerlendirmesinde kullanılan yöntemler, ihtiyaç duyulan kaynaklar ve raporlama olmak üzere beş başlıkta ele alınmıştır. Araştırma bulgularına göre velayet değerlendirmesinde bulunan adli destek görevlilerinin, eğitim seviyesi yurt dışı uygulamalarında velayet değerlendirmesi yapan ruh sağlığı profesyonellerinden daha düşük bulunmuştur. Ayrıca görevlilerin yarıdan fazlası velayet değerlendirme konusunda eğitim almaya ihtiyaç duymaktadır. Bir velayet değerlendirmesi için harcanan ortalama süre adli destek görevlileri için ihtiyaç duyulan sürenin altında olduğu gibi yurt dışı uygulamaların da gerisindedir. Velayet değerlendirmelerinde çoklu bilgi toplama yöntemi kullanan görevliler yurt dışı uygulamalarında sıklıkla kullanılan psikolojik test uygulamalarını en az sıklıkta kullanmaktadır. Velayete ilişkin kararlara bakıldığında ise görevlilerin en sık velayetin bir ebeveyne verilerek diğer ebeveyn ile kişisel ilişki kurulması kanaatinde bulundukları belirlenmiştir. Adli destek görevlilerinin velayet değerlendirme konusunda daha fazla uzmanlaşabilmeleri için eğitimlerin arttırılması, eğitim içeriklerinde psikolojik test uygulamalarına yer verilmesi ve adli sistem içerisinde formel bir konsültasyon yapılanması önerilmektedir. Adli destek görevlilerinin iş yoğunluklarının azaltılabilmesi için de istihdamın arttırılmasına yönelik düzenlemelere ihtiyaç duyulmaktadır.

Öz
This research, which is conducted to determine the methods used in custody evaluations in Turkey, is designed in a descriptive survey model. 292 legal support officers determined by proportional sampling method participate in the research. The data are collected with the questionnaire technique and the findings are discussed under five headings: the professional qualifications of the legal support officers involved in the custody evaluations, the characteristics of the custody evaluations, the methods used in the custody evaluation, the resources needed and the reporting. According to the research findings, the education level of the legal support officers who made the custody evaluation is found to be lower than the mental health professionals who made the custody evaluation in overseas practices. In addition, more than half of officers need training in custody evaluation. The average time spent on a custody evaluation is below the time needed for legal support officers and lags behind overseas practices. Officers who use multiple information collection methods in custody evaluations use psychological test applications, which are frequently used in overseas practices, at least. Considering the decisions regarding custody, it is determined that the officers most frequently think that custody should be given to one parent and a personal relationship should be established with the other parent. It is recommended to increase the trainings, to include psychological test applications in the training content, and to establish a formal consultation within the judicial system so that the legal support officers can specialize more in custody evaluation. In order to reduce the workload of legal support officers, regulations are needed to increase employment.
